The Biden Administration is making plans to appeal a ruling made by a federal judge in Florida on Monday who overturned the federal mask mandate in public areas such as the airport and public transportation.
U.S. District Judge Kathryn Kimball Mizelle struck down the mandate on the basis that it “exceeds the CDC’s statutory authority & violates procedures required for agency rulemaking”.
The Centers for Disease Control and Prevention said that it would continue to study whether the mandates were still needed. “We will continue to assess the need for a mask requirement in those settings, based on several factors, including the U.S. COVID-19 community levels, risk of circulating and novel variants, and trends in cases and disease severity,” a CDC spokesperson said in a statement on Tuesday.
Prior to Monday’s ruling, the mandate was going to expire on May 3 anyway. However, if the CDC finds that the mandates are necessary, then the Justice Department is ready to appeal Judge Kathryn Kimball Mizelle’s ruling.
