Federal Court Blocks Musk’s DOGE from Accessing Sensitive Treasury Data
New York Attorney General Letitia James has secured a major legal victory against Elon Musk’s Department of Government Efficiency (DOGE). On February 8, U.S. District Judge Paul A. Engelmayer issued a preliminary injunction blocking DOGE from accessing sensitive Treasury Department records. These records include Social Security numbers, bank account details, and other private information of millions of Americans.
Judge Engelmayer, an appointee of President Barack Obama, ruled that anyone prohibited from accessing this data must immediately destroy all copies downloaded from Treasury systems. The decision comes after 19 Democratic attorneys general sued to stop DOGE’s unauthorized access, calling it a violation of federal law.
Letitia James: “No One Is Above the Law”
In a video message released on February 7, Letitia James emphasized the dangers of Musk’s DOGE accessing sensitive data. “This unelected group, led by the world’s richest man, is not authorized to have this information,” she said. James warned that DOGE’s actions could lead to illegal freezes of federal funds, affecting critical programs like health care and child care.
James also highlighted the widespread fear among Americans. “Over the past week, my office has heard from more than a thousand New Yorkers who were afraid they would lose their privacy and funding,” she stated. The Attorney General praised the court’s decision, reaffirming that “no one is above the law.”
DOGE’s Access Called “Largest Data Breach in American History”
Connecticut Attorney General William Tong described DOGE’s actions as “the largest data breach in American history.” He accused the group of being an “unlawfully constituted band of renegade tech bros” combing through confidential records. The lawsuit alleges that DOGE’s access violates both federal law and the U.S. Constitution’s separation of powers doctrine.
Treasury Secretary Scott Bessent is also under fire for changing long-standing policies to allow Musk and his team access to sensitive data. The lawsuit claims this decision ignored legal obligations to protect taxpayer information and violated the privacy expectations of millions.
ACLU Joins the Fight Against DOGE’s Overreach
The American Civil Liberties Union (ACLU) has also stepped in to challenge DOGE’s actions. Nathan Freed Wessler, Deputy Director of the ACLU’s Speech, Privacy, and Technology Project, called on Congress to investigate the executive branch’s overreach.
In a press release, Wessler stated, “The American people deserve to know if their private financial, medical, and personal records are being illegally accessed.” The ACLU sent letters to Senate and House finance committees, urging them to hold the Trump administration accountable for allowing DOGE’s unauthorized access.

With the preliminary injunction in place, DOGE is now barred from accessing Treasury Department systems. The court’s decision is a significant step in protecting the privacy of millions of Americans. However, the lawsuit is ongoing, and further legal battles are expected.
