Letitia James vs. Musk & Trump: A Black Woman Blocks the Billionaire Takeover of U.S. Treasury

New York Attorney General Letitia James is proving once again that when Black women lead, justice follows. In a major legal victory, James and 18 Democratic attorneys general successfully secured a federal ruling that temporarily blocks Elon Musk’s controversial “government efficiency” team from accessing highly sensitive Treasury Department financial systems.

This decision, issued by U.S. District Judge Paul A. Engelmayer, comes after a lawsuit exposed how the Trump administration quietly gave Musk’s crew “unfettered access” to government payment databases—systems that control Social Security benefits, veterans’ payments, and federal employee wages. With this access, Musk’s team reportedly attempted to freeze funds meant for health clinics, preschools, and climate initiatives.

How Did We Get Here?

The Trump administration implemented a new policy allowing political appointees and “special government employees” to access financial systems that were previously restricted to career civil servants with security clearances. Under this policy, Musk’s team—operating under the so-called Department of Government Efficiency (DOGE)—was granted nearly unlimited access to federal financial data.

While the official reason for DOGE’s involvement was to help cut costs, the lawsuit, led by James, argues that Musk’s team was instead attempting to “block federal funds from reaching certain disfavored beneficiaries”—all without any legal authority. The move effectively bypassed Congress, which is the only branch of government with the power to control federal spending.

Letitia James Fights Back

Letitia James and a coalition of state attorneys general weren’t about to let this slide. They filed an emergency lawsuit, arguing that Musk and his team had no right to access Americans’ private financial information, nor the authority to manipulate government spending.

And they won—at least for now.

Judge Engelmayer’s ruling orders:

✔️ Immediate restrictions on Musk’s team from accessing Treasury Department data

✔️ Destruction of any and all copies of materials downloaded since January 20

✔️ A court hearing on February 14 to determine next steps

James made her stance clear:

    “President Trump does not have the power to give away Americans’ private information to anyone he chooses, and he cannot cut federal payments approved by Congress. Musk and DOGE have no authority to access Americans’ private information and some of our country’s most sensitive data.”

Why This Matters

This isn’t just about government bureaucracy—it’s about power, privacy, and the rule of law. The U.S. Treasury processes 90% of the government’s payments, handling more than $6.75 trillion in taxpayer money every year. Giving an unelected billionaire and his aides free rein over this system is unprecedented and dangerous.

Had James and her team not stepped in, Musk’s group could have continued redirecting or freezing government payments—directly affecting millions of Americans.

What’s Next?

The fight is far from over. On February 14, Judge Jeannette A. Vargas will hold a hearing to determine whether Musk’s access should be permanently revoked. Meanwhile, the Trump administration is expected to push back hard, likely arguing that DOGE’s involvement is necessary for “efficiency” and “cost-cutting.”

But James has made it clear—this isn’t about efficiency. This is about protecting Americans’ privacy, financial security, and constitutional rights.
