Roe v Wade

With the recent leaked draft opinion on overturning Roe v. Wade, a lot of folks want to know more about it and essentially understand what’s happening within the legal framework of the landmark case.

Now keep in mind, it’s not the drafted opinion being released early that we need worry about, but the actual possibility of Roe v. Wade being overturned and its future implications.

Per the leaked document obtained by @Politico, Justice Samuel Alito wrote, “Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. It is time to heed the Constitution,” Alito continued,” and return the issue of abortion to the people’s elected representatives.”

The issue with abortions is that there ISN’T a federal law that regulates them. Even with the precedent of the legal system, it all seems non-binding.

If congress were proactive they could nullify the way that the Supreme Court is trying to rule. With Congress and the Senate being split 50/50 – eh, it seems like men just can’t stay out of women’s business!

According to the #9thAmendment, the federal government doesn’t own or adhere to rights not listed in the constitution, meaning no one is limited to the laws pertaining to the #Constitution. So, at this point, it’s kind of like…does the Constitution even need to be considered in creating abortion laws? Especially if the states are left to make their own decisions with no outlier or flow to go by?

What are the practical implications? What’s actually going to happen? If passed, what are the resolutions being presented if abortion is taken off the table or comes with heavy penalties? Not to mention the children, the health issues, products of sexual assault, etc.

Prohibiting abortion does not mean “there will be no more abortions” it means women will be even more at risk because they no longer have safety measures in place or laws to uphold to ensure the safety of the woman if an abortion is needed or sought after.

Do you have a better understanding? We want to hear from you! Let’s discuss in the comments!
